I met Nick and the team in 2011. I was in need of some IT organization and it was not something I could easily do alone. Nick and his techs came to my office and documented all the system specifications for each PC. They also numbered each computer and created a network map to correspond to my building layout and where every machine is located.

As time went on, I began to use IT Support RI for more and more IT projects like creating backup solutions for my machinery, new workstations and servers, and recently, a long range wireless link between two of my buildings. They are familiar with my Amada setup and working with our Mietrak systems. I would recommend IT Support RI to any business in need of quality and personal IT support.

What is ITAR Compliance?

What Is ITAR Compliance?

International Traffic in Arms Regulations (ITAR) is a set of U.S. Government regulations that controls the export, import, and manufacture of defense-related products and services on the United States Munitions List (USML). The government requires all manufacturers, exporters, or contractors of defense articles, defense services or related technical data to be ITAR compliant.

Being ITAR compliant means that the company must be registered with the State Department’s Directorate of Defense Trade Controls (DDTC). Based on the DDTC’s website, the company must understand and abide by ITAR as it applies to their USML goods or services.

ITAR Compliance and Technology

ITAR affects the manufacture, sale, and distribution of defense-related articles, services and technology. Overall, these articles are in place to control and prevent information and/or technology from falling into the wrong hands.

This poses many challenges to companies that need to store or transfer data related to specific technologies over the internet. You need to understand how to properly secure your ITAR-controlled data. Every company will have different data security requirements, but here are some best practices to follow:

  • Maintain an information security policy
  • Build and maintain a secure network by installing and maintaining firewall configuration to protect data
  • Assign a unique ID to each person with computer access
  • Protect sensitive data with encryption
  • Track and monitor all access to network resources and sensitive data

Consequences of Being Non-compliant

It is important to understand that you need to register with the DDTC if you want to sell your products or services in the ITAR industry. However, being registered is not enough. You are expected to be educated and trained in implementing ITAR Compliance regulations.

Violations may result in criminal or civil penalties, being barred from future exports, imprisonment, or fines, including:

  • civil fines as high as $500,000 per violation
  • criminal fines of up to $1 million and 10 years imprisonment per violation

The manufacturer or exporter is responsible for taking the necessary precautions and steps to certify that they are meeting compliance requirements.
